Terms of Service

Welcome to (the "App"), provided by SweetSpot ("SweetSpot," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App, including any content, features, or services offered through it. By using, screenshoting or subscribing the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

The App is a subscription-based service that uses artificial intelligence to generate predictive insights on potential buy and sell points for individual stocks. These insights are delivered exclusively to subscribed users and are derived from historical market data, algorithms, and other publicly available information.

Important Disclaimers: These insights are provided for informational and educational purposes only and are not intended as financial, investment, trading, or personalized advice. We make no representations or warranties regarding the accuracy, completeness, timeliness, reliability, or profitability of any insights. There are no guarantees of profit, returns, or positive outcomes, and using these insights does not ensure successful trading results. Stock markets are highly volatile, market conditions can change rapidly (including due to unforeseen events), and past performance is not indicative of future results.

Users are solely responsible for conducting their own due diligence, assessing their risk tolerance, investing strategy, and personal financial situation, or any other products and service, is appropriate and suitable for users. The App does not provide real-time trading execution or account management services.

2. Accounts and Security

To access certain features of the App, you may be required to create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized access to or use of your account or any other breach of security. We reserve the right to disable any account at our discretion, including if we reasonably suspect that you have violated these Terms or applicable law.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the App. By using the App, you represent that you meet these requirements.

4. Subscription and Payments

Access to predictions requires a paid subscription. Subscriptions are billed monthly / annually in advance via Stripe. Fees are non-refundable except as required by law. We may change pricing with notice. You authorize recurring charges until cancellation. Cancel via Stripe customer portal; access ends at the billing period's close.

By starting a subscription, you authorize recurring charges to your selected payment method until you cancel. You can cancel your subscription at any time through the Stripe customer portal / your account settings; your access will continue until the end of the current billing period, and you will not receive a refund for the remaining time in that billing period unless required by applicable law.​

5.1 Third-Party Service Providers

The App integrates with trusted third-party service providers to deliver core functionality. These include:

  • Payment Processing: Stripe, Inc. handles all subscription payments, billing, and refunds according to their terms.
  • Web Hosting & Database: Google Firebase (Google Cloud Platform) provides hosting, authentication, storage, and real-time database services.
  • Analytics: Google Analytics for usage tracking and performance monitoring.
  • External Data: Public financial APIs (Alpha Vantage) for market data.

By using the App, you agree to these providers' terms of service and privacy policies. We are not responsible for their services, data practices, or service interruptions.

5.2 International Data Transfers

SweetSpot operates globally but stores data primarily in the United States via Google Firebase servers located in US data centers. This involves international data transfers from the EU/EEA (including Austria), UK, and other regions to the US.

We comply with applicable data protection laws including GDPR (EU), UK GDPR, and CCPA/CPRA (California). For EU/EEA/UK users, data transfers rely on Standard Contractual Clauses (SCCs) approved by the European Commission, supplemented by Google Cloud's Data Processing Addendum (DPA). You have the rights to access, correct, delete, or restrict your data—contact us to exercise them.

Our Privacy Policy provides full details on data handling, storage locations, retention, and your rights. Continued use confirms your consent to these transfers where required by law.

6. User Responsibilities

  • Use the App only for personal, non-commercial purposes.
  • Do not rely solely on our suggestions.
  • User requires to evaluate own investing strategy, financial situation, and risk tolerance.
  • You are responsible for all investment decisions and any resulting losses.
  • Do not share, copy, or distribute App content without permission.
  • Comply with all applicable laws, including securities regulations.

7. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT PREDICTIONS WILL BE ERROR-FREE, TIMELY, OR LEAD TO PROFITS. TRADING INVOLVES SIGNIFICANT RISK OF LOSS AND IS NOT SUITABLE FOR ALL USERS. YOU ASSUME ALL RISKS ASSOCIATED WITH USING THE APP.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, or damages arising from your use of the App, violation of these Terms, or infringement of third-party rights.

10. Intellectual Property

We own all rights to the App, AI models, and content. You are granted a limited, non-transferable license to use the App for personal use only. Do not modify, reverse-engineer, or create derivative works.

11. Termination

We may terminate or suspend your access at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ends immediately. We reserve the right to modify, suspend, or discontinue the App (in whole or in part) at any time, with or without notice, including for free users, subscription members, and founderEdition members. In the event we permanently discontinue the App, we may, but are not obligated to, offer refunds or other compensation, except where required by applicable law.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. You irrevocably agree that the state and federal courts located in the City of Wilmington, Delaware, United States shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation.

13. Changes to Terms

We may update these Terms with notice via the App or email. Continued use constitutes acceptance.

14. founderEdition Access and Service Availability

For the purposes of any 'founderEdition' access or membership, 'founderEdition' refers to the founderEdition of the Service (i.e., for as long as we continue to operate and make the Service commercially available), not the founderEdition of any individual user.

15. Privacy and Cookies

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal data. By using the App, you acknowledge that you have read our Privacy Policy and agree to our data practices as described there.

We use cookies and similar technologies for essential functionality and, with your consent where required by law, for analytics via Google Analytics. You can manage your cookie preferences through the cookie banner or settings available in the App and in your browser.
